By interacting with our AI-powered chatbot on Facebook Messenger, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use immediately.

2. Service Description
Our chatbot provides automated conversational responses using artificial intelligence technology (OpenAI GPT-4.1). The service includes:
- AI-powered message responses and information
- Conversation context maintenance across sessions
- Integration with Facebook Messenger platform
- Customer support escalation to human representatives during business hours
Important Notice: You are interacting with an artificial intelligence system, not a human representative.
3. AI-Generated Content Disclaimer
Limitation of AI Responses:
All responses generated by our AI system are informational only and should not be considered professional advice (legal, medical, financial, or otherwise). AI responses may contain inaccuracies, and we make no warranties about the completeness, reliability, or accuracy of AI-generated content.
Human Oversight:
For matters requiring professional judgment or critical decisions, request human assistance by typing "speak to human" or contacting michaelrandazzo@tanning.ai during business hours (Weekdays 9am-5pm EST).
4. User Conduct and Prohibited Activities
You agree not to:
- Use the service for illegal activities or to violate any laws

- Share false, misleading, or deceptive information
- Violate Facebook's Community Standards or Platform Policies

5. Data Collection and Processing

We collect your Facebook user identifier, message content, page identifier, and interaction timestamps as detailed in our Privacy Policy.

Your Consent:

Third-Party Processing:
Your data is processed by OpenAI (United States) under a Data Processing Agreement with appropriate safeguards. All other data processing occurs on our self-hosted infrastructure in Michigan, United States.

7. Service Availability and Performance

We strive to maintain 99.5% uptime during business hours. Response times are typically under 30 seconds, in compliance with Facebook's automated bot requirements.
Scheduled Maintenance:
We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice.
Service Dependencies:
Our service depends on Facebook's Messenger Platform and OpenAI's API. Service disruptions by these providers may affect our availability.
8. Intellectual Property Rights
Our IP:
The chatbot, its underlying technology, and all related intellectual property remain our property. You may not copy, modify, or create derivative works.
Your Content:
You retain ownership of the messages you send. By using our service, you grant us a limited license to process your messages for service delivery and improvement.
Third-Party IP:
OpenAI's technology is used under license. Facebook's Messenger Platform is used according to their Platform Terms.
9. Limitation of Liability
Service Disclaimer:
Our service is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Liability Limitation:
To the maximum extent permitted by Michigan law, our total liability for any claims arising from your use of our service shall not exceed $100. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
AI Response Limitation:
We are not liable for decisions made based on AI-generated responses. Always verify important information and consult qualified professionals for significant decisions.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our service, violation of these terms, or infringement of third-party rights.
11. Privacy and Data Protection
Your privacy is governed by our Privacy Policy, which forms part of these Terms. Key points:

12. Termination

13. Dispute Resolution
Informal Resolution:

Governing Law:
These terms are governed by Michigan state law and applicable federal law. For EU residents, EU consumer protection laws also apply.
Jurisdiction:
Disputes will be resolved in the courts of Michigan, except EU residents may choose their local courts for consumer disputes.

14. Changes to Terms

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
